Clarification Text On The Personal Data Protection Law

As Ulusu&Alaçam&Gönül Attorneys at Law (“UAG Law”), we care about ensuring the security of your personal data. Your personal data is processed, maintained, and protected by Vimfay in accordance with the general principles and personal data processing conditions in the Personal Data Protection Law No. 6698 (“KVKK”). For this purpose, we would like to inform you about the processing of your personal data, as a law firm that takes every precaution and shows the utmost sensitivity to the protection of data.

Our Personal Data Processing Principles

Your personal data is processed by us in the light of the following principles:

a) Lawfulness and fairness
b) Being accurate and kept up to date where necessary.
c) Being processed for specified, explicit, and legitimate purposes.
d) Being relevant, limited, and proportionate to the purposes for which they are processed.
e) Being stored for the period laid down by relevant legislation or the period required for the purpose for which the personal data are processed.

The Obligation of the Law Firm to Inform

According to Article 10 of the KVKK, data controllers are obliged to inform the data subjects while obtaining their consent on this issue. Within the scope of the relevant article, the Law Firm, which has the title of “data controller”, is obliged to inform the data subjects about the following:
a) the identity of the data controller and its representative, if any,
b) the purpose of the processing of personal data,
c) to whom and for which purposes the processed personal data may be transferred,
d) the method and legal basis for the collection of personal data,
e) other rights referred to in Article 11.

The aforementioned disclosure is made with this Clarification Text, and Vimfay informs and enlightens the persons whose personal data are processed under the provision of Article 10 of the KVKK.

Identity of the Data Controller

As per article 3/1 (ı) of KVKK, data controller means “the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system”. In this context, the Law Firm’s information is shared below for the concerned parties in order to contact the firm holding the title of data controller within the scope of KVKK.

Processing of Personal Data

The following personal data are processed within the scope of your relationship with the firm;

– Your name, surname, contact information,
– Information about your education, internship and career development,
– Information we obtain from your references and as a result of security/reliability screening in order to control your eligibility for employment,
– Your personal data that you provide with the application form, your CV and their content,
– Other information we may request about you within the scope of your job application.

Processing and Purposes of Personal Data

Your personal data is only processed with your explicit consent or in the presence of one of the following conditions of compliance with the law.
a) It is expressly provided for by the laws.
b) It is necessary for the protection of the life or physical integrity of the person himself/herself or of any other person, who is unable to explain his/her consent due to the physical disability or whose consent is not deemed legally valid.
c) Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract.
d) It is necessary for compliance with a legal obligation to which the data controller is subject.
e) Personal data have been made public by the data subject himself/herself.
f) Data processing is necessary for the establishment, exercise, or protection of any right.
g) Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.
Personal data relating to race, ethnic origin, political opinion, philosophical belief, religion, religious sect or other belief, appearance, membership to associations, foundations, or trade unions, data concerning health, sexual life, criminal convictions and security measures, and the biometric and genetic data which are sensitive personal data as per article 6 of the KVKK, can only be processed with explicit consent, and personal data other than health and sexual life can be processed without the explicit consent of the person concerned, in cases stipulated by the laws.

To Whom the Processed Personal Data Can Be Transferred and For What Purpose

Your personal data may be shared with private and public institutions and organizations and official authorities within the scope of the purposes listed above and when necessary for UAG Law to fulfill its legal obligations.
In the sharing of your personal data, the regulations in Articles 8 and 9 of the KVKK are complied with, and all kinds of technical and administrative measures are taken to ensure data security during and after the sharing process.
Pursuant to article 8 of the KVKK, personal data can be transferred without seeking explicit consent, in case of the explicit consent of the data subject or in case of one of the situations specified in article 2 titled ‘Processing Purposes’ above.
According to this; your personal data is transferred from time to time to our business and solution partners, government institutions and organizations, and private institutions and organizations within the scope of and limited to the purposes described above.

Personal Data Collection Method and Legal Reasons

Your personal data, which we process for the purposes listed above, can be obtained in a physical or electronic environment and by other methods. In the processing of your personal data, the conditions specified in the 5th and 6th articles of the KVKK and the “Processing Purposes” above are complied with, and your consent is sought when required by law.
Again, the relevant personal data may be processed to fully and accurately fulfill the obligations arising from the legislation and/or contracts, and in line with the purposes specified in this Clarification Text, and may be transferred to the persons specified under the heading “To Whom the Processed Personal Data Can Be Transferred and for What Purpose”.

Right of the Relevant Person

As the relevant person, we inform you that you have the right to request from us about you;
• to learn whether your personal data are processed or not,
• to demand information as to if your personal data have been processed,
• to learn the purpose of the processing of your personal data and whether these personal
data are used in compliance with the purpose,
• to know the third parties to whom your personal data are transferred in the country or abroad,
• to request the rectification of the incomplete or inaccurate data, if any,
• to request the erasure or destruction of your personal data under the conditions referred to in Article 7,
• to request reporting of the operations carried out according to sub-paragraphs (d) and (e) to third parties to whom your personal data have been transferred,
• to object to the occurrence of a result against yourself by analyzing the data processed solely through automated systems,
• to claim compensation for the damage arising from the unlawful processing of your personal data.
It is possible to submit your requests about your rights and your other requests regarding the implementation of the Law to us in writing or by other methods to be determined by the Personal Data Protection Board.
UAG Law will finalize your requests free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff to be determined by the Personal Data Protection Board may be charged.

How Do We Protect?

All necessary technical and administrative measures are taken by the Law Firm in order to protect the personal data collected and processed by the Law Firm, to prevent it from falling into the hands of unauthorized persons, and to prevent the real and legal persons with whom it cooperates are not aggrieved. The Law Firm ensures that the software used in the firm’s activities complies with the standards, that the third parties to be worked with are carefully selected, that the employees receive training in this regard, and that other regulations enacted within the Law Firm are complied with.

Right to Apply and Obtain Information

Regarding your personal data, within the scope of Article 11 of the KVKK, if the person concerned wishes to exercise any of the rights described above, he/she may apply to VIMFAY as a data controller.
This application must be made to the Law Firm in writing or by other methods determined by the Personal Data Protection Board. We have prepared an application form for you in the link below so that you can make your applications easier.

Please submit the completed application form to the Law Firm;
• By coming to the address of the Law Firm, Çukurambar Mahallesi Muhsin Yazıcıoğlu Caddesi Park Apartmanı No:10/8 Çankaya – Ankara / Türkiye personally (the applicant comes in person and fills in the application form with his/her identity card),
• By sending it to the Law Firm’s address Çukurambar Mahallesi Muhsin Yazıcıoğlu Caddesi Park Apartmanı No:10/8 Çankaya – Ankara / Türkiye via notary public or return receipt requested,
 By sending to the Law Firm’s registered e-mail address [email protected], using a secure electronic signature, mobile signature, or e-mail address previously notified to us by the relevant person and registered in the Law Firm’s system, or,
 By electronically filling out the following part of our website.
Regarding your applications submitted to the Law Firm through the above-mentioned ways, you will be responded to within 30 (thirty) days from the date of receipt by the Law Firm, according to paragraph 2 of Article 13 of the KVKK. Our answer will be delivered to you in writing or electronically.
